FMCSA lowers minimum annual random drug testing percentage rate
The Federal Motor Carrier Safety Administration (FMCSA) announced on Dec. 21 that effective Jan. 1, 2016, the minimum annual random drug testing percentage rate for drivers subject to DOT-testing rules will decrease to 25 percent.
The reduction comes as a result of the positive rate for random drug testing falling below the one-percent threshold for three consecutive calendar years. If the positive rate climbs back above the one-percent threshold the FMCSA can revert the minimum testing rate back to 50 percent.
Despite the reduction in the minimum annual rate, motor carriers will still be able to test at a rate higher than 25 percent in 2016, according to the law firm Littler Mendelson.
