Settlement discussions continue for McDonald’s applicants in lawsuit over FCRA violations

The plaintiffs in a suit against a McDonald’s restaurant operator are requesting final approval for a settlement amount of $950,000.

Named plaintiff James Carter urged a U.S. district judge to grant final approval of the proposed class action settlement arguing the terms are both fair and appropriate. The judge had preliminarily approved this settlement figure in an October 2016 hearing pending changes and with provisional certification of the class.

The lead plaintiff originally filed suit when he was fired based on the results of an inaccurate background check. The class-action lawsuit alleged that employees and applicants were not provided with separate notifications that they would be subject to a background check. The suit further alleges that employees and applicants were denied employment or fired based on the findings of background checks without having an opportunity to contest or explain the results of the reports, as required by the FCRA.
