Reminder: Employees with an SSA TNC Issued in 2021 or Prior Should Visit Local Office by March 31

USCIS recommends that employees with a E-Verify Social Security Administration (SSA) Tentative Nonconfirmation (TNC) issued in 2021 visit their local SSA office to resolve the TNC by March 31, 2023.

As Business Information Group has previously reported, the SSA stopped all processes related to resolving E-Verify TNCs for the majority of 2020 and 2021. On July 15, 2022 USCIS resumed normal TNC resolution operations; in October, they issued a reminder to employers that employees issued SSA TNCs should resume normal TNC correction protocol. The announcement also recommended that employees wait to begin resolving their SSA TNCs depending on the date the case was referred to SSA. USCIS has stated that these timeframes are recommended, but that all employees must visit SSA to resolve their TNC by the final deadline of September 29, 2023 or their case will automatically fall into Final Nonconfirmation Status.

According to the chart below, employees with Referral Date Confirmations issued in 2021 should strive to visit the SSA before March 31, 2023. Employees with Referral Date Confirmations between March 2 to December 31, 2020 that have not yet resolved should visit SSA for a TNC resolution as soon as possible.

Clients should reach out and encourage employees to comply with the "preferred" dates listed above so as to allow ample time for case resolution and completion prior to the September 2023 deadline. This process of resolving outstanding SSA TNCs is required regardless of whether you are enrolled in BIG's automatic E-Verify service.
